Many of our clients are referred to us by previous clients and by other lawyers who recognize our expertise in looking after their client’s personal injury cases. Whether it is acting for a client from the outset, assuming carriage of an existing case or assisting as trial or appellate counsel, we are happy to offer our expertise for your benefit and the benefit of your clients.


Our program provides specific  legal services in personal injury law and civil litigation to clients of other lawyers who do not offer this as part of their law practice.  The following provides information to help lawyers better understand the referral process and how the fees are divided.

In the province of Ontario, Rule 2.08 explicitly accepts the practice of referral fees and also the practice of dividing fees between co-counsels.  The Rule clearly states that referral fees cannot be paid to anyone other than a paralegal or lawyer.  The referral must be made because of the expertise and ability of the Ontario lawyer or paralegal receiving the referral fee and not because of a conflict of interest.  The referral fee must be reasonable and must not increase the total fee charged to the client. There is no assistance in determining what reasonable means however

We pay competitive referral fees to other lawyers in accordance with the rules set by The Law Society of Upper Canada. The usual fee is 10-15% of our total fee depending upon the type of file, risk involved, the level of our success, and the amount we’ve paid out in disbursements.  The formula was actually incorporated into a precedent standard law firm partnership published by the Canadian Bar Association years ago.

As far as our firm’s expectation to receive a referral fee, it would be typically only in a contingency fee situation. As with most personal injury practices, the vast majority of our work is done on a contingency fee basis, receiving a percentage of the recovery as our fee.
